Terms of Service

These Terms of Service (the “Terms”) are a binding agreement between you and FPV Technologies Inc, a Delaware corporation (“Jobby”, “we”, “us”), the operator of getjobby.ai and the Jobby application (the “Service”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Who can use Jobby

You must be at least 18 years old and able to form a binding contract. You agree to provide accurate information about yourself and your work history, and to keep it up to date. You are responsible for everything done under your account.

2. What the Service does

Jobby helps you find and apply to jobs. Depending on your plan, the Service sources live job postings, scores them against your profile and preferences, generates tailored CVs and cover letters, and — when you enable it — submits applications on your behalf, either automatically or after your review.

Jobby is a tool to assist your job search. We do not employ you, do not guarantee any interview, offer, or outcome, and are not a party to your relationship with any employer or recruiter.

3. Your authorization — applying on your behalf

This section is important. When you enable application submission (auto-apply or review mode), you appoint Jobby as your limited agent for the sole purpose of finding roles, preparing application materials, and submitting applications for you. Specifically, you authorize Jobby to:

  • Submit applications to employers, applicant tracking systems, recruiters, and job boards using the information in your profile and the documents Jobby generates for you.
  • Create accounts in your name on third-party employer, ATS, recruiter, and job-board websites where an account is required to apply. You authorize Jobby to complete those sign-up forms with your information and to agree, on your behalf, to those sites’ own terms as a candidate applicant.
  • Generate, store, and use login credentials for those accounts so that Jobby can log in and apply for you. Credentials are encrypted at rest. You can view, change, or delete stored credentials at any time from your settings, and you remain free to log in to those accounts yourself.
  • Provide and operate a Jobby email address for you (e.g. on a Jobby subdomain) to receive account-verification and recruiter messages related to those applications. You authorize Jobby to process verification links to complete sign-ups and to forward relevant messages to your own email address.

You may withdraw this authorization at any time by turning off application submission, deleting stored credentials, or closing your account. Withdrawal does not affect applications already submitted or accounts already created.

You represent and warrant that the information you provide is true and accurate, that you have the right to apply to the roles in question, and that you authorize the actions above. You are responsible for the applications submitted for you, including in automatic mode; review mode is available if you want to approve each submission first.

4. Limits of what Jobby will do

Jobby is designed to act only through legitimate, candidate-facing application flows. Jobby does not solve or circumvent CAPTCHAs or other human-verification challenges, and does not automate sessions on sites whose terms prohibit it (including LinkedIn and Indeed). Where a site cannot be completed automatically, Jobby will hand the application back to you to finish. Some applications will therefore require manual steps from you.

5. Acceptable use

You agree not to use the Service to:

  • provide false, misleading, or fraudulent information in applications;
  • apply for roles you are not legally permitted to perform, or impersonate another person;
  • break the law, infringe anyone’s rights, or violate a third-party site’s terms in a way these Terms do not authorize;
  • interfere with, overload, reverse-engineer, or attempt to gain unauthorized access to the Service.

6. Third-party sites and employers

The Service interacts with employer, ATS, recruiter, and job-board websites that we do not own or control. Your use of those sites is governed by their own terms and privacy policies. We are not responsible for their content, availability, hiring decisions, or how they handle your data once an application is submitted.

7. Plans, limits, and billing

Jobby offers free and paid plans. Paid plans include a monthly limit on the number of applications Jobby will submit, as described at sign-up. Fees, limits, and features may change; we will give notice of material changes and they will not apply retroactively to a period you have already paid for. Unless stated otherwise, fees are non-refundable except where required by law.

8. Your content and our platform

You keep ownership of the information and documents you provide (your “Content”). You grant Jobby a licence to use, store, process, and transmit your Content as needed to operate the Service for you — including generating tailored documents and submitting them on your behalf. Jobby and its software, design, and branding remain our property.

9. Data and privacy

We process your personal data — including your CV, the credentials Jobby manages for you, and the messages received at your Jobby address — to provide the Service, in accordance with applicable data protection law (including the UK GDPR) and our Privacy Policy. Credentials are encrypted at rest and used only to apply on your behalf. You can delete your data by deleting the relevant items or closing your account.

10. No guarantee; “as is”

The Service is provided “as is” and “as available”. We do not warrant that it will be uninterrupted or error-free, that every application will be delivered successfully, or that using Jobby will result in any interview, offer, or job. To the fullest extent permitted by law, we disclaim all implied warranties.

11. Limitation of liability

To the fullest extent permitted by law, Jobby will not be liable for any indirect, incidental, special, consequential, or punitive losses, nor for any lost opportunities, lost earnings, lost job offers, or damage to reputation, arising from or relating to your use of the Service — including any application Jobby submits, declines to submit, submits incorrectly, or fails to submit, and any account Jobby creates or manages on your behalf. Our total aggregate liability for all claims relating to the Service will not exceed one hundred US dollars (US$100). Nothing in these Terms limits or excludes any liability that cannot be limited or excluded under applicable law.

12. Indemnity

You agree to indemnify Jobby against claims and losses arising from information you provided being untrue, from your breach of these Terms, or from your misuse of the Service.

13. Suspension and termination

You can stop using the Service and close your account at any time. We may suspend or terminate your access if you breach these Terms or use the Service unlawfully. On termination, the authorizations in Section 3 end going forward; you remain responsible for closing or managing any third-party accounts created for you, and you can export or delete your stored credentials before you leave.

14. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will give reasonable notice (for example, by email or in the app). Continuing to use the Service after changes take effect means you accept the updated Terms.

15. Governing law

These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-laws rules, and the state and federal courts located in Delaware have exclusive jurisdiction, except where mandatory local consumer law gives you other rights.
